1. About Azcarte

Menulify is a digital menu platform for restaurants, bars, cafés, and similar businesses. It is operated by GEDARK SOLUTIONS, SIRET 90255785900011, 74100 Ville-la-Grand, France.

By creating an account or using the service, you agree to these terms. If you do not agree, do not use Azcarte.

2. Accounts

You must provide accurate information when registering. You are responsible for maintaining the security of your account credentials. Notify us immediately at support@azcarte.com if you suspect unauthorised access.

One account corresponds to one business entity. You may invite staff members who act under your account's authority and whose use is your responsibility.

3. Subscription and Billing

Plans and free trial

Azcarte offers a free plan and paid subscription plans (Standard and Pro). Every new account receives a complimentary free trial with full Pro access. The duration of the trial is displayed at the time of registration and may vary depending on the current offer. No credit card is required to start. At the end of the trial, the account automatically moves to the Free plan unless a paid plan is activated.

Billing

Paid plans are billed in advance on a monthly or annual basis. All payments are processed by Stripe. By subscribing, you agree to Stripe's terms of service. Azcarte never stores your payment card details.

Subscriptions renew automatically unless cancelled before the renewal date. You can cancel or manage your subscription at any time via the Stripe billing portal, accessible from your account. Cancellation takes effect at the end of the current billing period; you retain access until that date.

Plan changes

You may upgrade or downgrade your plan at any time. When you change plans mid-cycle, Stripe calculates a prorated amount for the remaining days of the current period. Any amount owed is charged immediately; any credit is applied to your next invoice.

If a downgrade reduces your plan limits (for example, fewer staff accounts or languages), features that exceed the new limits will be deactivated, not deleted. Your content is preserved and can be reactivated if you upgrade again.

Refunds

We do not offer refunds for partial billing periods, except where required by applicable law (including EU consumer regulations).

4. Acceptable Use

You may use Azcarte only for lawful business purposes. You must not:

  • Upload content that is illegal, defamatory, or infringes third-party rights
  • Attempt to gain unauthorised access to the platform or other users' accounts
  • Use the service to send unsolicited communications
  • Resell or sublicense access to Azcarte without our written consent
  • Interfere with the platform's operation through automated scraping, denial-of-service attacks, or similar means

We reserve the right to suspend or terminate accounts that violate these rules, without prior notice where necessary to protect the service or other users.

5. Your Content

You retain ownership of all content you upload to Azcarte (menus, product descriptions, images, etc.). By uploading content, you grant GEDARK SOLUTIONS a non-exclusive, royalty-free licence to store, display, and serve that content solely to operate the service.

You are solely responsible for ensuring that your content is accurate, does not infringe any third-party rights, and complies with applicable laws (including food labelling regulations in your jurisdiction).

If you use the assisted translation feature, product names and descriptions are sent to a third-party AI provider (xAI) to generate translation drafts. Translations are provided as a starting point and may require manual review and adjustment before publishing. We do not guarantee the accuracy of AI-generated translations.

6. Menu Accuracy and Product Photography

All menu content published through Azcarte — including product names, descriptions, prices, ingredients, allergen information, and photographs or other media — is created, managed, and published exclusively by the account holder (the business operating the venue).

GEDARK SOLUTIONS bears no responsibility for the accuracy, completeness, or up-to-date nature of any menu content. In particular:

  • Product photographs and images are provided for illustrative purposes only. The actual appearance, presentation, or composition of a dish or product may differ from images shown.
  • Prices, availability, and product specifications are subject to change without notice and are the sole responsibility of the venue.
  • Allergen and nutritional information, if provided, must be verified directly with the venue. Azcarte does not validate or certify allergen declarations.

By publishing a menu on Azcarte, you acknowledge that you are solely liable to your customers for any discrepancy between published content and the products actually served or delivered. You agree to keep all menu information accurate and up to date and to indemnify GEDARK SOLUTIONS against any claims arising from inaccurate or misleading content.

7. Intellectual Property

All software, design, trademarks, and branding belonging to Azcarte remain the exclusive property of GEDARK SOLUTIONS. Nothing in these terms grants you any rights in Menulify's intellectual property beyond a limited licence to use the service as described.

8. Service Availability

We aim to provide a reliable service but do not guarantee uninterrupted availability. We may perform maintenance at any time; we will try to give advance notice for scheduled downtime.

Azcarte is provided "as is". To the extent permitted by law, we exclude all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose.

9. Limitation of Liability

To the fullest extent permitted by applicable law, GEDARK SOLUTIONS' aggregate liability to you for any claim arising out of or relating to these terms or the service shall not exceed the amount you paid to us in the 12 months preceding the claim.

We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits or business interruption, even if we were advised of their possibility.

10. Termination

You may delete your account at any time. Upon deletion, your data will be removed within 30 days, except where retention is required by law (see our Privacy Policy).

We may terminate or suspend your account if you breach these terms, if required by law, or if we discontinue the service. We will provide reasonable notice where possible.

11. Changes to These Terms

We may update these terms from time to time. We will notify registered users by email at least 14 days before material changes take effect. Continued use of the service after that date constitutes acceptance of the updated terms.

12. Governing Law and Disputes

These terms are governed by French law. Any dispute that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the courts of Annecy, France.

If you are a consumer resident in the EU, you may also use the European Commission's Online Dispute Resolution platform.
